These Terms & Conditions do not constitute an offer, solicitation or invitation to play Pro-Active Games Cricket Scratchie in any jurisdiction in which playing Pro-Active Games Cricket Scratchie is illegal or prohibited.  All terms and conditions are listed below and a participant is responsible for determining the laws and regulations that applies to Pro-Active Games Cricket Scratchie in their own country.

Definitions:

SMS Response means short message service or text message received from Pro-Active Games.

Eligible Participant means any person who is not an Ineligible Participant.

Ineligible Participant means any person whom Pro-Active Games in its absolute discretion, determines is not eligible to play Pro-Active Games Cricket Scratchie and includes (without limitation):

  1. each cricket player, who is a member of either team (including its wider squad) or plays in the league taking part in the relevant T20 and/or ODI that is a featured televised and streamed Pro-Active Games Cricket Scratchie, and the immediate family of any such player (including a spouse, grandparent, parent, child and grandchild, whether by marriage, remarriage, adoption, co-habitation or other family extension);

  2. each world football player, who is a member of either team (including its wider squad) or plays in the league taking part in the relevant world football match, that is a featured televised and streamed Pro-Active Games Soccer Scratchie, and the immediate family of any such player (including a spouse, grandparent, parent, child and grandchild, whether by marriage, remarriage, adoption, co-habitation or other family extension);

  3. each baseball player, who is a member of either team (including its wider squad) or plays in the league taking part in the relevant baseball game, that is a featured televised and streamed Pro-Active Games Baseball Scratchie Game, and the immediate family of any such player (including a spouse, grandparent, parent, child and grandchild, whether by marriage, remarriage, adoption, co-habitation or other family extension);

  4. a Participant who is resident in and enters Pro-Active Games Scratchie via the Pro-Active Games Website, and does so using someone else’s logon details, without the consent of the Participant concerned.

  5. a Participant who is a resident in or whose mobile carrier operates for the purposes of Pro-Active Games Scratchie in a country in which either the offering of, or participation in, Pro-Active Games Scratchie is illegal or in which Pro-Active Games is required to be, but is not, licensed or authorised to offer Pro-Active Games Scratchie

  6. a Participant who uses a ‘prepay’ from his mobile carrier to enter Pro-Active Games Cricket Scratchie and who does so without sufficient credit on his or her phone.

  7. a Participant who uses a mobile phone that has an ongoing mobile account but the account is not in the name of the Participant, unless the Participant can prove to Pro-Active Games satisfaction that he or she is the ‘real’ winner.

  8. a Participant is under the legal age of eighteen for competitions in Australia, and other jurisdictions.

  9. each director and employee of Pro-Active Games, and or any of its promoters and or advertising agents of Pro-Active Games and the immediate families of each such director and employee. (including a spouse, grandparent, parent, child and grandchild, whether by marriage, remarriage, adoption, co-habitation or other family extension);

You means each person who enters Pro-Active Games Cricket Scratchie

General:

The game is Pro-Active Games Cricket Scratchie : Pro-Active Games Cricket Scratchie is run by Pro-Active Games in Australia and other certain jurisdictions.

All rights, including copyright, trademarks and other intellectual property rights in Pro-Active Games Cricket Scratchie or in materials supplied or made available as part of Pro-Active Games Cricket Scratchie are owned by Pro-Active Games, and may not be duplicated or infringed in any manner by any person.

If You are an Ineligible Participant and You enter Pro-Active Games Cricket Scratchie, any fees or charges charged to You by Your mobile carrier or taken out of Your credit card payments account and or PayPal account are not refundable, and Your Pro-Active Games Cricket Scratchie entry will not be valid. If Your Pro-Active Games Cricket Scratchie entry is nevertheless accepted for any reason, any Prizes awarded must be returned by, or is not awarded to You.

  4. You are responsible for locating suitable internet access and or checking a mobile coverage map for details.

  5. Pro-Active Games accepts no responsibility for loss or damage that may arise from entering Pro-Active Games Cricket Scratchie or for any other liability arising from You entering Pro-Active Games Cricket Scratchie All liability of Pro-Active Games to You or any other person, whether in tort (including negligence), in contact, under statute or otherwise, is expressly excluded to the maximum extent permitted by law. You release and agree to keep Pro-Active Games indemnified from any claim, cost, demand, tax liability or damage suffered or incurred by Pro-Active Games or its Directors, employees, arising out of You entering Pro-Active Games Cricket Scratchie

  6. Pro-Active Games reserves the right to require You to provide at any time such information as Pro-Active Games deems necessary to satisfy itself that You are an Eligible Participant. If You fail to provide sufficient information that satisfies Pro-Active Games in its absolute discretion that You are an Eligible Participant, You are deemed to be an Ineligible Participant.

  7. Pro-Active Games reserves the right to withhold Prizes of a winning Pro-Active Games Cricket Scratchie entry, and/or to declare any Pro-Active Games Cricket Scratchie entry void, if Pro-Active Games believe for any reason that of match-rigging has taken place as a result of which the integrity of a Take That! Cricket Match, a Pro-Active Games Cricket Scratchie World Football Match and a Pro-Active Games Cricket Scratchie Baseball Game may be called into question.

  8. Pro-Active Games disclaims any responsibility for Your inability to enter, to complete the entering process or to continue entering in Pro-Active Games Cricket Scratchie, due to equipment or technical malfunction, overloaded or busy servers, lines or cell sites, inadvertent disconnection, Acts of God or any other reason whatsoever whether outside Pro-Active Games control or otherwise.

  9. None of Pro-Active Games, nor Pro-Active Games Cricket Scratchie is, or are, associated with, or affiliated to, any international, national or domestic cricket association, authority or governing body. Neither Pro-Active Games, nor Pro-Active Games Cricket Scratchie is or are associated with the running of any T20 and/or ODI that is a Pro-Active Games Cricket Scratchie Cricket Match.

  10. None of Pro-Active Games, nor Pro-Active Games Cricket Scratchie is or are associated with, or affiliated to, any international, national or domestic world football association, authority or governing body. Neither Pro-Active Games, nor Pro-Active Games Cricket Scratchie is or are associated with the running of any world football match that is a Pro-Active Games Cricket Scratchie World Football Match.

  11. None of Pro-Active Games, nor Pro-Active Games Cricket Scratchie is or are associated with, or affiliated to, any international, national or domestic baseball association, authority or governing body. Neither Pro-Active Games, nor Pro-Active Games Cricket Scratchie is or are associated with the running of any baseball game that is a Pro-Active Games Cricket Scratchie Baseball Game.

  12. Any personal information You provide to Pro-Active Games is subject to the Privacy Policy. The information collected may include Your full name/ Your date of birth/Your postal and email address and/Your telephone number, both home and mobile.

  13. Failure by Pro-Active Games to enforce any of these T & C’s does not constitute a waiver of its right to do so.

  14. You may be required to prove to the satisfaction of Pro-Active Games, in its absolute discretion that You are the owner of the mobile telephone and the mobile carrier account from which the winning Take That! entry was sent and, or, You are using Your own logon details on the Pro-Active Games website to enter Pro-Active Games Cricket Scratchie and that You are not an Ineligible Participant.

  15. Collection and or delivery of prizes will be advised in the redeem prizes section on the Pro-Active Games Website. Pro-Active Games and are not under any obligation for the failure of You to collect or receive Your Prizes.

  16. If an error is made in the notification of a Prize, however caused, Pro-Active Games, reserves the right to correct the error.  The name of each winner of Pro-Active Games Cricket Scratchie may be published on the Pro-Active Games Website, or in the various media selected by Pro-Active Games.  By participating in Pro-Active Games Cricket Scratchie You consent to publication and waive any claim to any remuneration for publication.

  17. You win Your Prize at Your own risk.  Where Your Pro-Active Games Cricket Scratchie entry was submitted from a mobile phone that is on account, the account holder is presumed to be the winner, unless the “real” Participant can show otherwise. The same applies where Your Pro-Active Games Cricket Scratchie entry was submitted via the Pro-Active Games website. Pro-Active Games will give the Prize out to the person who claims the Prize subject to appropriate proof of ‘eligibility’. Pro-Active Games, reserves the right not to award the Prize if insufficient proof is given to it, that You are both the winner and an Eligible Participant. If there is a dispute between the account holder and the Participant, Pro-Active Games, will determine in its absolute discretion who is deemed to be the winner, based on whatever evidence it deems necessary. Pro-Active Games and or any of its licensed agents, decision is final.
